Most California divorces address certain cornerstone issues, including:
- Division of property – Essentially, how will you divide and allocate all of the assets and debts acquired and accrued during the marriage. Generally, the rule of the thumb is that everything a married couple owns and owes together will be split 50/50. Unfortunately, this deceptively simple concept can be complex.
- Child custody and visitation – What will be the time-share schedule for when the children will be with each parent? Is it practical? How far do the parents anticipate living from one another? What are their work schedules, and will it accommodate the time they are proposing? How will the parents make decisions about the health, education, and welfare of the children?
- Child support – Child support payments are calculated based on a formula established under California law. There are many factors but arguably the two most important are the parents respective incomes and the amount of time they actually spend with the children.
- Spousal support – The purpose of paying spousal support is to lessen unfair economic effects that the divorce will have on the lower-earning spouse and to help that spouse maintain the marital standard of living they enjoyed while married.
